The regular monthly meeting of the South Annville Township Board of Supervisors was held in the Community Building at 7:00 PM. Chairman Dale Hoover presided. Present were Dale Hoover, Chester Horst, John Harrell, Donald Umberger, Jeanette Henning, Jim Caldwell, Chief Ben Sutcliffe, Ed Kreider, Ed Fogelsanger, Mark Stanley and Nathan Cheney of Garman Builders and others.
The meeting opened with a pledge to the Flag and a moment of silence.
Chester Horst moved and John Harrell seconded a motion to approve the Secretary’s Report. Motion passed 3-0.
Chester Horst moved and Dale Hoover seconded a motion to accept the Treasurer’s Report. Motion passed 3-0.
Mark Stanley, Attorney for Garman Builders presented an updated plan for the Mayapple Development to the Supervisors. The project plans that were approved seven years ago have been updated to allow for a new Phasing Schedule along with a new repayment schedule for the development. The Conditional Use Agreement was approved and the Phasing Schedule is as follows: Phase I is scheduled to begin breaking ground by the end of this year (2017). Phase II is scheduled to break ground in 2020 and Phase III in 2024. Along with the updated Phasing Schedule, Garman Builder’s Conditional Use Agreement reflects the reduction of the number of units being built to, Phase l-56, Phase II-55 and Phase III-43. Garman has approval from the Authority to repay the $300,000.00 owing on the pumping station, serving the development, in payments with the start of each Phase.
Jim Caldwell of Rettew Associates reported, three Road Bids were submitted and opened from Pennsy Supply, EK Services and Handwerk. The Road Project will need to be completed by September 15th of this year. Jim recommended awarding the bid to Pennsy Supply whose bid was $193,044.12. Motion was made by Chester Horst and seconded by Dale Hoover to award Pennsy Supply the bid, motion passed 3-0. Jim also told the Supervisors the MS-4 waiver application is still pending, so the Supervisors tabled the discussion on joining the consortium to next month’s meeting.
Jim Caldwell confirmed that both parties are now in agreement on the Sunoco Road Use Agreement and security values have been established. Chester Horst moved to accept the Sunoco Road Use Agreement and John Harrell seconded. Motion passed 3-0. Chief Sutcliffe met with Sunoco Security Personnel who said that once started, Sunoco expects to be in South Annville Township for three to four weeks, having at any one time up to 150 personnel on site. With the Williams Pipeline Road Use Agreement almost ready to be adopted (mileage numbers will need to be corrected), Dale Hoover read the motion to accept the Road Use Agreement between South Annville Township and Williams/Transcontinental Gas Pipeline Company: I move that the Board of Supervisors approve the South Annville Township Road Use Agreement between the Township and Transcontinental Gas Pipeline Co. in the form submitted to the Board by the Township’s Solicitor and that the Board approve the execution of the Agreement by the Board Chairman subject to and following execution of the Agreement in its current form by an authorized representative of Transco and receipt of security and escrow funds as set forth in the Agreement as verified by the Township Engineer and Township Solicitor. Dale Hoover moved and John Harrell seconded the Adoption of the Resolution. Motion Passed 3-0.
Donald Umberger informed the Supervisors that there are three residences and two businesses that fall within the Township’s 150 foot mandatory sewer hook-up. Donald Umberger read a letter from the Chairman of the Authority concerning the mandatory sewer connection as follows: It is my understanding that at the time of the sewer line installation there was no requirement for the three residential and one commercial property to hook up. Since the instillation has been completed it is recommended that all of the above mentioned properties be required to hook up to the sewer by a resolution/ordinance . Supervisors recommended having Township Solicitor, Josele Cleary provide the required resolution/ordinance that would pass for all of South Annville Township properties that fall within the 150 feet distance. Donald reminded the Supervisors about the Annville Township’s offer to join them in bidding a joint township garbage collection agreement for the year 2018. At the present time the Supervisors declined the invitation with a request for more information.
Donald Umberger had Supervisors revisit the request to review and update the Township’s Sign Ordinance. The Supervisors decided to have Township Solicitor, Josele Cleary prepare an ordinance that will allow for billboards to be placed in Commercial and Industrial Districts only. they requested a legal but restrictive use of signs in all districts.
Donald also told the Supervisors that the owner of 310 Quittie Park Drive has decided not to rebuild the home that was destroyed by fire. The Kovorik Law Suit continues with no new advancements. As soon as the Township receives the permit to repair the Killinger Road Bridge the clock will start ticking and the Township will have 60 days to make the repairs. He also updated the Supervisors that the State has placed the cable on Old Mt. Gretna road to do a traffic use count, once completed the State will send a report to the Federal Government. A request to have a brake retarder sign placed along Route #422 has been denied by the State.

John Harrell moved and Chester Horst seconded a motion to approve the Secretary’s Report after a minor correction. Motion passed 3-0.

Kurt Yorty a resident of South Londonderry asked Supervisors to update the sign ordinance to allow electronic and non-electronic billboards to be placed within the Township.
Jim Caldwell of Rettew Associates confirmed that he spoke with a representative from DEP concerning the 537 Plan in which there will need to be flow meters installed when the treatment plant is connected. Jim requested Donald Umberger to contact John Vanderhoff (Palm City) for his comments on the proposed sewer agreement between Palm City and the Township. Jim also noted that the 2017 road projects have been advertised on Penn Bid. Several companies have looked at the bids. Jim expects at least two bids. The bids will come in Friday, April 7th at 2 PM. They will be reviewed and he will make a recommendation for awarding the bids at the next Supervisors Meeting. Township Manager, Donald Umberger stated that the paving of the intersection on Rte. #422 is scheduled for April 15th and was hoping to combine paving projects if Pennsy is awarded the bid.
Jim continued with the Sunoco Pipeline road use agreement which concerns vehicles using South Mt. Pleasant or Beech Street. Michael Iseley of Sunoco estimates that approximately 250 vehicles will use Township roads. Jim Caldwell strongly encouraged Sunoco to use state routes. Sunoco will video the starting conditions of roadways that will be used. If any damage is incurred there will be a record of extent of damage. The Township will receive a copy of the dvd. Sunoco, as per the language on page 16 of the agreement, will have a security reserve which will be maintained throughout the pipeline project in order to repair any damages as they occur. Sunoco is very anxious to get moving. Jim and Township Manager, Donald Umberger will work together to finalize the agreement for signatures at the next Supervisor’s Meeting. Dale Hoover moved and Chester Horst seconded a motion to allow Jim and Donald to accept Sunoco’s agreement as long as they are comfortable with the agreement terms. Motion passed 3-0.
Kara Kulupson from Rettew Engineering gave the annual update on the Township’s Storm Water Management Program (MS-4) in which she listed the criteria that needs to be met in order for the Township to meet DEP’s regulations for the permit process.
Donald Umberger informed the Supervisors the number of non-pumpers is zero. He also noted the Township could use the free fill that is being offered by Garman Development to improve the intersection at Louser Road and Rte. #934. He went on to say that Annville Township has extended an offer to join them in bidding a joint township garbage collection agreement for the year 2018.
Donald Umberger updated the Supervisors about the Killinger Road Bridge Project. The project is 70% complete on developing the repair plan and the permit application to submit to DEP. The plan and application is being prepared by Wilson Consulting Group, PC. The Supervisors and MFS are in negations about an area to be used for recreational activities. Dale Hoover has reached out to the Annville Youth League and they provided him with a 4 page wish list. The South Annville Authority and MFS are close to an agreement for the sewer extention and the Township looks forward to the agreement being executed.
Donald also presented the Supervisors with a copy of the Township Solicitor, Josele Cleary’s letter about a meeting that she attended concerning the MS-4 Consortium. The Supervisors tabled the decision to join the Consortium until they have more information. The Kovarik law suit continues. 911 Rapid Response, a new South Annville Township business has surpassed their goal of having at least 25 employees on staff as a result of moving their business to South Annville Township, by having a present total of full and part time employees of 42. Candler Point Preliminary Plans have been disapproved. After filing for an extension for the past eleven years, Lebanon County Planning Department has refused a 12th request. The Township has an updated credit card which uses new technology. The Township’s Code of Ordinances has been updated to a Folio version on the internet (which will make looking up codes easier) by American Legal. Sometime in the March to June time frame, PennDot will place a cable across Old Mt. Gretna road to measure traffic usage. Supervisors were given the #6 Supplement for Townships of Second Class Codes. Township Secretary alerted Supervisors to a conflict which involves two neighbors in the Township.

Jim Caldwell of Rettew Associates confirmed that a letter of response has been sent to Servant Oasis concerning their on-lot sewer numbers. If Servant Oasis decides to install a small flow treatment plant the process will have to be approved and monitored by DEP, in the event that DEP is doing the approving and monitoring Servant Oasis will have to submit project plans to the Township for acknowledgement of the plans. Jim also would like to meet with the operator of the Vander Homes Treatment Plant to make sure that the numbers agree with the calculated flow numbers for capacity. Jim will have a representative follow up with John Vanderfoffer before he communicates with DEP.
Jim Caldwell also said that after Williams Pipeline made some minor changes, the road agreement will be reviewed again before signing it. Jim will also prepare and send a letter to Sunoco Pipeline (cross over Beech Street & South Mt. Pleasant road) in order to have a road agreement signed with them. He continued with a request for approval of the placement of monuments in Bachman Run-Phase 1 & 1A. Jim said that using monuments instead of pins is a more permanent solution for surveying purposes. Richard Boltz (County Engineer) would need a letter from the Township stating that the Supervisors approve of using four monuments. Dale Hoover moved and John Harrell seconded a motion to approve using four monuments. Motion passed 3-0. The Township Secretary will forward the notice to Richard Boltz.
Donald Umberger informed the Supervisors that there is one Township residence that has not complied with the sewer pumping (non-pumper). The Township will start action on property owner/s March 1, 2017 if property is still in a non-compliant status.
Donald Umberger updated the Supervisors about the Killinger Road Bridge Project. The project is 40% complete on developing the repair plan and the permit application to submit to DEP. The plan and application is being prepared by Wilson Consulting Group, PC. Donald also asked the Supervisors for authorization to advertise for bids on the 2017 Proposed Road Projects. Jim Caldwell suggested having the bids ready for the April Township meeting with proposed completion dates of August or September 2017. Chester Horst moved and Dale Hoover seconded a motion to advertise bids. Motion passed 3-0.
Donald Umberger informed the Supervisors that the application for county aid will be sent to Jon Fitzkee at the Lebanon County Planning Department for his approval, the Jon will submit application to PennDot. Donald also informed Supervisors that Township Solicitor, Josele Cleary will make some suggestions about updating the Township’s billboard and sign codes section. Another update was given about the ruling of the final appeal from Hoffer Pavement in which the ruling was in the favor of the Township and that the Kovarik law suit will be handled by the Township’s insurance company.
Donald went on to report that DJH Associates LLC defaulted in paying their taxes on their property located north of Fink’s Development, so the bank has assumed ownership. In March of this year, the property will go into foreclosure. Township Colicitor, Josele Cleary suggests filing a sales agreement that the property/land will not be developed unless the Townhip is paid. South Annville has always used Elected Township Auditors to perform the Township’s Annual Audit. The Township would like to hire a CPA firm to take over of the annual audit. In order for this to take place a resolution would need to be proclaimed, then said resolution would have to be advertised for thirty days. After that the Township would have to appoint a CPA firm. With the annual audit deadline of April 1st looming and the Elected Township Auditors ready for their auditing duties to take place, the Supervisors have decided to use the Township Auditors for the 2016 Audit and use the rest of 2017 to hire a CPA firm. This will give the Township ample time to interview CPA firms. Dale Hoover moved and John Harrell seconded the motion to use the Township’s Elected Auditors for the 2016 audit. Motion passed 3-0.
Jeanette Henning gave the following report for 2016 regarding permits issued: Estimated Construction Costs Totals-$13,149 million and Fees Collected Totals-$16,714.00. 101 Permits were issued for 2016. Jeanette will have a comparison spreadsheet showing the previous year permit numbers for review at the March Township meeting.

Chief Sutcliffe gave the monthly report. Chief Sutcliffe also said that due to the proposed opening of Rutter’s at the new intersection of Killinger Road and Main Street; he has suggested that the Palmyra Run that is scheduled for May and will use a portion of Killinger Road be rerouted and Killinger not be a part of the run. The Palmyra Recreation Board is now seeking an alternate route for the Run and will share their plans with the Police Department when completed.

Dale Hoover moved and Chester Horst seconded a motion to accept the minutes of the Organization Meeting which was held Tuesday, January 3, 2017 with an addition to appoint Ellen DiSantas as an alternate to the South Annville Township Planning Commission. Gordon Sheetz, Chairman of the South Annville Planning Commission presented two plans from Steckbeck Engineering, for review and approval. Both plans are lot additions. First plan is located at the North East corner of Spruce Street & Bricker Lane, which transferred from Tom Segal of Gray Dancer LLC to Leonard & Donna Jefferson. John Harrell moved and Chester Horst seconded the move to approve plan. Motion passed 3-0. The second plan is a small parcel of land located on Bowman Lane, which transferred from Donald Bowman to Barry Donmoyer. Chester Horst moved and Dale Hoover seconded the move to approve plan. Motion passed 3-0.
Jim Caldwell of Rettew Associates reported that the MS-4 waiver that was submitted to DEP has a very good chance of being approved and the Township should know if approved sometime in February. He also had communications with Bethany from DEP saying that the 537 Plan continues in the ongoing study phase. Jim Caldwell will have the final documents to accept the Road Dedication at The Meadows of Bachman Run at next month’s meeting. He also was instructed to send the Williams Pipeline draft agreement to Williams for their review. Jim presented Servant Oasis’s sewer flow calculations to the Supervisors giving their estimated consumption of water and sewer usage per day if the land is developed. Gordon Sheetz questioned whether a treatment plant would be needed to support their anticipated use. He went on to say that Oasis would have to have a module plan submitted to DEP which would be the first step in the process of moving forward with their sewage plant. DEP will have the final say for a package treatment plan. Jim Caldwell will draft a letter subject to DEP’s terms and suggested that this matter be revisited at next month’s meeting.
Donald Umberger presented information to the Supervisors about Elder Care Housing and how it could affect the residents of South Annville. The Elder Care Housing could be a temporary solution to residents who would like to take care of a family member (s) on their property without having to make a full land development plan. The Supervisors asked Jim Caldwell to expand on this item. Jim gave Supervisors both pros and cons ending with his personal thoughts of this being something of a good thing. Supervisors decided to table any further discussion on this matter until more could be learned. Donald Umberger reported to the Supervisors that 176 Valley View Lane is now in compliance with Township Ordinances. He also informed the Supervisors that the number of delinquent sewer pumpers is down to tow residences from a starting list of 36. Donald also updated the Supervisors about the Killinger Road Bridge reporting that Wilson Engineering has tested the site and found no wetlands or endangered species.
Chester Horst gave an update on the signs for the Township and Police Offices. The work will be done by Boyer’s Signs of Palmyra with a total invoice of $1,095.77. After a brief discussion on dimensions, letter coloring and pole material to be used John Harrell moved and Chester Horst seconded a motion to accept Boyer’s bid. Motion passed 3-0.

Chief Sutcliffe gave the monthly and yearly reports. He also asked the Supervisors on behalf of Mark Fratteroli, the President of the Annville-Cleona Cross Country Booster Club, for their approval in using the South Annville Township Police Department for their assistance in the clubs 4th Annual Bunny Run which will be held April 15th, 2017 at 9:00 AM. The run would not require any road closings. The Chief signified his approval and Dale Hoover moved and John Harrell seconded a granting of the request. Motion passed 3-0.
