The Zoning Hearing Board hears appeals on the validity of the Zoning Ordinance, Zoning Map, or any decision of the Zoning Officer. In addition, the board has the power to grant variances and special exceptions to the ordinance. This is a three-member, quasi-judicial board consisting of residents of the municipality who are not permitted to hold any other elected or appointed position.
The Zoning Hearing Board must appoint its own solicitor (legal counsel) to assist in its deliberations, writing decisions, and appeals. The Township Solicitor is not permitted to be the Zoning Hearing Board Solicitor, since the opinions and decisions of the Zoning Hearing Board may differ from the views of the Supervisors. The Supervisors may, like any affected citizen, appeal a decision of the Zoning Hearing Board to the courts.
Each member of the Zoning Hearing Board is appointed by the Board of Supervisors for a term of three years. Every year, one of the board members’ terms expires, or they are reappointed by the Board of Supervisors.
